2. Services Offered

We offer AI-assisted brand visual services to marketing teams and brand leads. Our current service tiers are:

Service scope, deliverables, and timelines are confirmed in a written service summary issued before work begins. Any changes to agreed scope require written acknowledgement from both parties.

3. Enquiries and Engagement Process

Submitting an enquiry through our website does not constitute a service agreement. An engagement begins only when we have issued and you have accepted a service summary in writing.

• We will respond to enquiries within 2 working days.
• A briefing call may be scheduled before a service summary is issued.
• We reserve the right to decline any engagement at our discretion.

4. Fees and Payment

Fees are stated in Malaysian Ringgit (RM) and are inclusive of all applicable charges unless otherwise stated in the service summary. Payment terms are as follows:

• A deposit of 50% is required before work begins.
• The remaining balance is due upon delivery of final outputs.
• Payment is accepted via bank transfer to the account details provided in the invoice.
• We reserve the right to pause work where payment is overdue by more than 7 calendar days.

Prices are subject to change. Any changes will apply to new engagements only and will not affect confirmed service summaries already in progress.

5. Intellectual Property and Visual Usage

All visual outputs produced during an engagement are subject to the usage terms discussed and documented in your service summary. The following general principles apply:

• AI-generated visuals: Outputs produced using AI tools are discussed with you at the review stage. Usage scope and any applicable third-party platform terms are covered during the review session.
• Style guides and workflow documents: These are prepared for your internal use and may be adapted freely by your team.
• Our proprietary materials: Methodologies, internal processes, and templates shared during engagements remain the property of Obscura Mint and may not be redistributed or resold.

We recommend that your team seeks independent advice on broader intellectual property questions related to AI-generated visual content before commercial publication.

6. Client Responsibilities

To allow us to complete work to the agreed standard, you agree to:

• Provide accurate and complete briefing materials in a timely manner.
• Participate in scheduled review sessions as agreed.
• Ensure that any materials you supply to us (brand assets, guidelines, reference images) do not infringe third-party rights.
• Communicate change requests in writing before additional work is carried out.

7. Cancellations and Scope Changes

If you wish to cancel an engagement after work has begun, please contact us in writing. The following applies:

• The 50% deposit is non-refundable once work has commenced.
• Work completed up to the cancellation date will be invoiced at the applicable pro-rata rate.
• Requests to expand or reduce service scope will be assessed and documented in a revised service summary.

8. Limitation of Liability

To the extent permitted by Malaysian law, Obscura Mint's total liability in connection with any service engagement shall not exceed the fees paid for that specific engagement.

We are not responsible for:

• Decisions made by you based on visual outputs following your review and approval.
• Third-party platform policy changes that affect how AI-generated visuals may be used after delivery.
• Indirect losses, loss of revenue, or consequential damages arising from the use of our services.

9. Website Use

The content on this website is provided for informational purposes. While we take care to keep it accurate, we do not warrant that all content is complete, current, or error-free. You use the website at your own discretion.

We reserve the right to update or remove content at any time without notice. Linking to our website from third-party sites is permitted for non-commercial editorial purposes; framing or embedding our pages without prior written consent is not permitted.

10. Privacy and Cookies

Your personal data is handled in accordance with our Privacy Policy. Information on how we use cookies is set out in our Cookie Policy. Both policies form part of these Terms and should be read alongside them.

11. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising in connection with these Terms or our services will be subject to the non-exclusive jurisdiction of the Malaysian courts.
